trying to reproduce your problem but seems
for me everything worked w/o any problem. 

CVS was yesterday's sync.

dvbstream was used to successfully broadcast a channel
over eth0 and mplayer played it on remote computer.

module paramter dvb-core dvb_shutdown_timeout=0 was 
used to disable frontend shutdown because of dvbstream.

it was tested on 2 cards:

dvb-ttpci-budget-patch.o (tuner alps_bsrv2)
dvb-ttpci-budget.o (tuner stv0299)

I tried mutliply times to start/stop dvbstream which
tuned the card, all worked well.

If I could not reproduce it, it does not mean
bugs don't exist.

We should try with changed _bh locks, just to compile
the modules properly and we can try that.
