I have used some ts analyzers, and I cant remember the names, that will
show a the stream as a VBR when it is a CBR.  The reason for this is
that it is looking at the I, P and B frames which would cause the stream
to look like a VBR instead of a CBR.  I don't know if this is the same
for you.
