Depends on your A/V receiver.  If yours is able to receive
and decode S/P-DIF none PCM even without marked as NONE AUDIO
in the second status bit, then it works.  On the other
side you could use the bitstreamout plugin with the
appropiate sound card which supports NONE AUDIO S/P-DIF.

But you may have to fix the dvd plugin to not to receive
padding data and PS1 frames from the dvd plugin its self.
